Examinations of Work Areas in Underground Coal Mines for Violations of Mandatory Health or Safety Standards
On December 27, 2010, the Mine Safety and Health Administration (MSHA) will publish a proposed rule in the Federal Register on Examinations of Work Areas in Underground Coal Mines for Violations of Mandatory Health or Safety Standards (30 CFR Part 75).
The proposed rule would revise MSHA’s requirements for preshift, supplemental, on-shift, and weekly examinations of underground coal mines. The proposal would require operators to identify violations of mandatory health or safety standards. The proposed rule would also require that the mine operator record and correct violations and review with mine examiners (e.g. the mine foreman, assistant mine foreman, or other certified persons) on a quarterly basis all citations and orders issued in areas where preshift, supplemental, on-shift, and weekly examinations are required.
The proposed rule will be available for viewing on December 22, 2010, at 11:15 a.m. at the Federal Register Public Inspection Desk: http://www.federalregister.gov/inspection.aspx. The list of Fatal Accident Investigation Reports, as well as the citation and order narratives for non-fatal accidents cited in the preamble to the proposed rule, is available for viewing at: http://www.msha.gov/UpcomingRules/UpcomingRules.asp
The comment period will close on February 25, 2011.
