OSHA Sets Whistleblower Complaint Rules under Food Safety Act

OSHA has published an interim final rule governing the employee protection (whistleblower) provision found at section 402 of the FDA Food Safety Modernization Act.  The interim rule establishes procedures and time frames for the handling retaliation complaints under the Act, including procedures and time frames for employee complaints to OSHA, investigations by OSHA, appeals of OSHA determinations to an administrative law judge (ALJ) for a hearing de novo, hearings by ALJs, review of ALJ decisions by the Administrative Review Board, and judicial review of a decision.  The interim final rule is effective February 13, 2014.  Comments are due April 14, 2014.  http://www.gpo.gov/fdsys/pkg/FR-2014-02-13/html/2014-03164.htm
