EPA Final Rule on Commercial and Industrial Solid Waste

EPA has published a final rule containing decisions made when it granted reconsideration in December 2011 of its March 2011 final rule, “Standards of Performance for New Stationary Sources and Emissions Guidelines for Existing Sources: Commercial and Industrial Solid Waste Incineration Units.”  EPA has denied requests for reconsideration of all issues raised in the petitions.  This final rule sets effective dates for the standards and makes technical corrections to clarify definitions, references, applicability and compliance issues.  EPA is also issuing final amendments to regulations codified by the Non-Hazardous Secondary Materials rule promulgated March 2011 to provide standards and procedures for identifying whether non-hazardous secondary materials are solid waste under RCRA when used as fuels or ingredients in combustion units.
