California Announces March 13 Meeting on Proposed Changes to Repeat Violations

Cal/OSHA announced a March 13 meeting to discuss proposed changes to the definition of “repeat violation” in California regulations.  The changes to section 334(d) would increase the statute of limitations for a repeat violation from 3 years to 5 years.  It would change the geographic limit of a repeat citation to statewide for fixed locations.  Thus, an employer’s repeat violation in San Francisco would be a repeat violation for a citation issued to the same employer’s in San Diego.  Thanks for Tom Butler of ASSE’s California Government Affairs Committee for sharing this information.
