As safety professionals know, OSHA possesses what appears to be the ultimate trump card in Section 5(a)(1) of the OSHA Act, which is commonly referred to as the General Duty Clause. Given its breadth, Section 5(a)(1) has often been litigated. This session will provide practitioners with permissible legal limits to the application of the General Duty Clause.
